DroneUp, LLC (“DroneUp” or “we”, or “us”) operates the “DroneUp” mobile device apps (“Apps”) found at the Apple App Store and the Google Play Store and the “Sites” referenced in the list of URLs found at the end of this document. This page informs you of our policies regarding the collection, use and disclosure of Personal Information, Log Data and Drone Data we receive from users of the Apps and Sites.
We use your Personal Information, Log Data and Drone Data to improve the Apps and Sites and to communicate with you. By using the Apps and Sites, you agree to the collection and use of information in accordance with this policy.
GDPR
Under the EU General Data Protection Regulation 2016/679 (“GDPR”), effective as of May 25, 2018, European Union data subjects are entitled to certain specific rights with respect to processing of their personal data.
Under the GDPR, in certain circumstances, you have the right to:
- Request access to your personal information
- Request the correction of inaccurate or incomplete personal information
- Request that your personal information be erased
- Object to the processing of your personal information, including processing for direct marketing purposes
- Request that the processing of your personal information be restricted
- Request that you receive your personal information in order to transfer it to another data controller
- Withdraw at any time your consent to the use of your personal information
- Make a complaint to an EU Data Protection Authority where you believe that we have not complied with our obligations under this Privacy Policy or applicable European data protection law (including the GDPR)
- We will not transfer your personal information to third parties located outside of the EEA without taking steps to ensure adequate protection under the GDPR. If a third party is located in a country not recognized by the EU Commission as providing an adequate level of protection, we will use appropriate measures, such as entering into standard contractual clauses, approved by the EU Commission, to protect your personal information.
Personal Information
While using our Apps and Sites, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you. Personally identifiable information may include, but is not limited to your name, postal address, email address, phone numbers, FAA registration and certificate numbers, social media accounts, third-party logins (i.e., DJI and/or other drone manufacturers), credit card information, chat communications (“Chat”), images, and videos.
We may receive your Personal Information from other sources, such as drone manufacturers, public data sources, marketing partners and social media platforms. We may receive your Personal Information from your social media friends or from other third parties. If you elect to log in to our Apps using your social media account, certain Personal Information from your social media account will be shared with us, including Personal Information from your social media profile or the social media profiles of your friends.
Log Data
Like many mobile app and site providers, we collect information that your browser sends whenever you visit our Apps or Sites (“Log Data”). This Log Data may include information such as your computer’s Internet Protocol (“IP”) address, browser type, browser version, the pages of our Apps and Sites that you visit, the time and date of your visit, the time spent on those pages and other statistics.
In addition, we may use third party services such as Google Analytics that collect, monitor and analyze this Log Data to give us insights that help us make our products better.
Drone Data
When you use our Apps to look at advisory maps and when you indicate that you are “Drone Up”, we may collect data (“Drone Data”) about your drone’s operation, including its make and model, physical location, flight path, speed, altitude, temperature and other information that identifies the drone and its flight.
Use of Personal Information, Log Data and Drone Data
We may use your Personal Information to contact you with newsletters, marketing or promotional materials and other information that we think would be potentially useful to you. We may share your Personal Information with third parties in the UAS or related industries for the purpose of contacting you with newsletters, marketing or promotional material that we think would be potentially useful to you. We may use your Personal Information, Log Data and Drone Data to facilitate social media sharing, chat communications and credit card payments that you authorize.
We will use your Log Data to help us improve the Apps and Sites. We may aggregate your log data with other users’ Log Data to provide general insights on drone operation to drone manufacturers, third party partners, law enforcement agencies or the FAA.
We may use your Personal Information, Log Data, Drone Data as we believe to be necessary or appropriate to comply with legal requests from public safety and government authorities.
We will not share your physical address or phone numbers with third parties.
Accessing and Correcting Your Personal Information
You can review and change your personal information by logging into the App and visiting your account profile page. Should you wish to delete your account, click on the “Delete my Account” button in the App. Once you do so, your account will be designated as deactivated for a period of 30 days. During this 30-day deactivation period, you are able to log onto the App and reactivate your account by clicking the “Reactivate” button. If you do not reactivate your account within the 30-day deactivation period, your account and all of your personal information will be permanently deleted from our system.
Media and Sharing Your Information
Any information or content that you voluntarily disclose for posting to DroneUp, such as User Content, becomes available to the public, as controlled by any applicable privacy settings that you set. Once you have shared User Content or made it public, that User Content may be re-shared by others, including DroneUp. The User Content may be used for promotional efforts by DroneUp, including but not limited to posting on the https://www.droneup.com website and relevant secondary pages, DroneUp social media accounts, DroneUp press releases, and DroneUp news.
Cookies
Cookies are files with small amount of data, which may include an anonymous unique identifier. Cookies are sent to your browser from a web site and stored on your computer’s hard drive. Like many sites, we use “cookies” to collect information. You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. However, if you do not accept cookies, you may not be able to use some portions of our Sites.
LAANC Data
“LAANC Data” is the information entered into the functions defined in the USS-FAA LAANC Interface Control Document (ICD), that DroneUp either sends to the FAA or receives from the FAA, for the purpose of processing or managing LAANC authorizations. LAANC Data includes: (a) Personally Identifiable Information (PII) data that is collected, handled, shared, or stored, for the purpose of processing or managing LAANC authorizations (e.g., the operator’s first name, last name, phone number, and email address); and (b) All non-PII data collected, handled, shared, or stored, for the purpose of processing and managing LAANC authorizations (e.g., start date, time, and duration of the operation; maximum altitude; geometry airspace class(es); submission reference code; safety justification for non-auto-authorized operation; and aircraft registration number used to obtain an authorization from the FAA). Information becomes “LAANC Data” when the UAS Operator provides the information that is entered into the functions defined in the USS-FAA LAANC ICD, to DroneUp, with the intent that such information be used for LAANC authorizations; or when DroneUp receives the information that is entered into the functions defined in the USS-FAA LAANC ICD from a third party, and subsequently the information is affirmatively validated by the UAS Operator, with the intent that such information be used for LAANC authorizations.
DroneUp is collecting the LAANC Data from UAS operators using DroneUp’s LAANC capability. The LAANC Data will be retained by DroneUp for 3 years and may be shared with third parties for UAS operators who opt-in to such LAANC Data sharing as set forth below. The LAANC Data is used by DroneUp for the purposes of supporting DroneUp commercial operations.
By using DroneUp’s LAANC system, the UAS operator:
• has affirmed their acceptance to DroneUp’s data usage and security policies and any sharing of that data with third parties; and
• grants to DroneUp a worldwide, royalty-free, fully paid-up, non-exclusive, perpetual, irrevocable, transferable and fully sublicensable (through multiple tiers) license to use the LAANC Data that is provided by the UAS operator or derived from the LAANC Data provided by the operator for the purposes described herein, which is the extent to which DroneUp claims intellectual property rights in the LAANC Data; and
• agrees to allow DroneUp to share LAANC Data with the FAA pursuant to federal law, regulations, DroneUp’s agreement with the FAA, and the FAA's USS Performance Rules then in effect.
UAS operators may request a copy and / or request destruction of their LAANC Data that is collected by DroneUp. Any such request should be sent to [email protected].
Location
One of DroneUp’s missions is to make flying drones safer for everyone. Capturing the location of our safe operators who have their drones up is an important aspect of the DroneUp app.
To gain full use of our Apps and Sites, we will ask permission within our Apps and Sites to have access to your mobile device location. We will use this location information to display location-specific flight advisories and to record where you have gone “Drone-Up”. Other people and organizations using the DroneUp app, including local law enforcement, will be able to see where DroneUp users are located when they are DroneUp (their drones are in flight). You will also be able to see where other DroneUp app users are in flight. This ability to see where drones are operating is a critical safety feature of the DroneUp app and an important reason to use the app.
In addition to capturing location activity while using the DroneUp application, DroneUp will request background location access to be granted. With this permission granted, the DroneUp application will, from time to time, tell us about your device’s location even if you are not directly interacting with the application. This information is necessary to determine proximity to missions that you may be eligible to participate in and subsequently provide notifications of that respective mission availability for elective participation. Additionally, this information can be used to provide safe flight notifications while piloting different devices. Declining background locations will not inhibit users from participating in missions, however, immediate notification of available missions will not be provided until the user logs into the application.
Security
The security of your Personal Information is important to us, but remember that no method of transmission over the Internet, or method of electronic storage, is 100% secure. While we strive to use commercially acceptable means to protect your Personal Information, we cannot guarantee its absolute security.
Changes To This Privacy Policy
This Privacy Policy is effective as of November 16, 2017 and will remain in effect except with respect to any changes in its provisions in the future, which will be in effect immediately after being posted on this page.
We reserve the right to update or change our Privacy Policy at any time and you should check this Privacy Policy periodically. Your continued use of the Service after we post any modifications to the Privacy Policy on this page will constitute your acknowledgment of the modifications and your consent to abide and be bound by the modified Privacy Policy.
If we make any material changes to this Privacy Policy, we will notify you through the email address you have provided us, or by placing a prominent notice on our website. You may also opt to receive in-app notifications of any changes made to the privacy policy by adjusting your notification settings within the mobile app.
